Missouri lawmakers passed HB 446 on May 6, 2013. Gov. Jay Nixon let the July 12 deadline pass without taking any action on the bill. His inaction means the legislation takes effect on August 28 without his signature. The bill essentially states that the enforcement and servicing of real estate loans secured by a mortgage, deed of trust, or other security instrument is subject only to state and federal law. The bill, sponsored by Rep. John Diel, makes it clear that no local law or ordinance can be enacted that would affect any loan agreement or "impose fees or taxes of any kind or require payment of fees to any government contractor related to any real estate loan agreement, mortgage or deed of trust, other security instrument, or affect the enforcement and servicing thereof." Both the city of St. Louis and St. Louis County had previously put foreclosure mediation ordinances in place that required lenders to pay for mediation and levied $1,000 and $500 fines, for the city and county respectively, against any person or company in violation of the mediation statute. The state legislature's HB 446 makes those mediation ordinances null and void. The attorneys at South & Associates, P.C., which has an office in St. Louis, explained that HB 446 "would promote uniform banking laws and prohibit any Missouri County from establishing its own foreclosure mediation ordinance . . . . Currently, the litigation concerning the validity of both the St. Louis County and St. Louis City mediation ordinances remains pending, and the firm will continue to monitor the litigation to determine whether HB 446 renders both cases moot."
