2 If there's one thing the national debate about the display of the Confederate flag shows us it's this: e United States still has a race problem. It stains our national consciousness. But that's stating the obvious. Perhaps there is no more prominent manifestation of the issue than in the area of housing. Housing discrimination has been a topic of debate going back at least half a century. Since the passage of the Fair Housing Act in 1968, the federal government has taken a number of smaller steps that to further refine the law and move closer to the goal of equal housing opportunity for all. ere is still work to be done. is month we look at two recent developments. First, e Supreme Court ruled that disparate impact claims can legally be brought about under the Fair Housing Act. Disparate impact is a doctrine that has been greatly expanded by the Obama Administration in the past six years, according to some, to the detriment of the industry. Second, HUD announced that it had finalized the Affirmatively Furthering Fair Housing Final Rule, which will help communities that receive HUD funding get the help they need to meet fair housing obligations in the use of HUD funds. Time will tell if they hit the mark. Also this month, we took the opportunity to catch up with former HUD Secretary Henry Cisneros. Cisneros served for four years under President Clinton and was the first Hispanic mayor of a major city (San Antonio). He's currently working on a bipartisan initiative with a couple of former Senators to expand housing opportunity for middle and lower income families. We talked to him about his time at HUD, his views on current policy, and what he's up to now. Further, after months of ignoring the cries of the industry and saying that there would be no delay in TRID implementation, the CFPB's failure to file the appropriate paperwork will result in exactly that. It looks like the delay is going to be until October 3, more than two months after the original date. We asked Richard Horn, formerly Senior Counsel with the CFPB, who worked on TRID implementation before his departure, to tell us what happened from a former insider's perspective. What happened?
