ATTORNEY OVERSIGHT AND COMPLIANCE—CURRENT AND FUTURE ISSUES IN LAW FIRM COMPLIANCE During this panel, our distinguished speakers will discuss the future of on-site audits, IT, and information security issues facing firms and the industry, as well as management of firms' third-party vendors. MODERATOR RYAN BOURGEOIS, Partner | BDF Law Group Ryan Bourgeois manages the Texas, Colorado, and Georgia foreclosure groups and serves as the firm's Compliance Officer. He attended Texas Christian University, earning a finance degree in 2002. He received a Juris Doctor from Southern Methodist University Dedman School of Law in 2005. Bourgeois is currently licensed in Texas, Georgia, and Colorado. He is currently a member of the Legal League Advisory Council, the Special Initiatives Working Group, and Chair of the Events Committee.. Bourgeois is also a member of the USFN Publications Committee and Advocacy Task Force. SPEAKERS MICHAEL MERRITT, SVP, Mortgage Default Servicing | BOK Financial Michael Merritt manages the default servicing area at BOK Financial, including the collection, loss mitigation, foreclosure, bankruptcy, property preservation, post-sale, claims, and loss analysis teams. Prior to joining BOK Financial, he oversaw mortgage sub-servicers at Goldman Sachs. Merritt also managed many areas at Mr. Cooper Mortgage, primarily in customer care, loss mitigation, and business controls. He has an MBA from Texas Tech University, and a bachelor's in organizational leadership from Arizona State. MELISSA BLACK, First VP, Default Services | PennyMac Loan Services, LLC As First VP, Default Services, at PennyMac Loan Services, LLC, Melissa (Missy) Black is responsible for the Foreclosure team, including timeline management and compliance. Black is an industry veteran with nearly 20 years' experience across servicing technology and performance management. Outside of work, you're likely to find her on a patio somewhere with her husband, listening to live music, watching football, at a classic car show, or hanging out at home with her two shih tzus. MARK ATENCIO, EVP | Lyons McCloskey Mark Atencio, EVP, Lyons McCloskey, has been in the mortgage industry 25+ years in servicing and origination. Prior to Lyons, he was with Ditech for 16 years, serving as SVP of Servicing Risk and Business Control; at KB Home as SVP Chief Credit Officer; at Shea Mortgage as SVP Credit and Operations; and served as VP of Credit at BoA and PNC. His passion for industry progress drew him to chair the MBA Loan Administration Committee and participate in many committees such as leading the Law Firm Oversight Standardization with 20+ servicers, 14 law firms, three auditors, and three associations with results supported by the GSEs, OCC, and CFPB. J. ANTHONY VAN NESS, Founder, Managing Attorney | Van Ness Law Firm, PLC J. Anthony "Tony" Van Ness is the Founder and Managing Partner of Van Ness Law Firm, a Florida default and litigation law firm with locations in Deerfield Beach and Miami. The firm has represented national mortgage lenders and servicers since 2004, making it one of the older default firms serving Florida and likely the only certified, African-American one. The firm has won several performance awards over the years and takes pride in becoming Fannie Mae-retained counsel in 2010 (until the program ended). In addition, Van Ness serves on multiple boards for trade, associations, and charity. 11:15 A.M.–12:10 P.M. This discussion is designed to bring you experienced perspectives on HAF funds, loss mitigation, foreclosure delays, and e-notes/e-mortgages. MODERATOR CAREN CASTLE, Senior Attorney | IDEA Law Group, PLLC Caren Jacobs Castle is a Senior Mortgage Servicing Attorney at IDEA Law Group. Castle has over 30 years' experience in the mortgage servicing industry and many honors. She is a past President of USFN and was the organization's first female President. She also served as the first Chairperson of the Board of the Legal League. Castle was honored by the Five Star Institute in 2011 for outstanding leadership and service to the housing industry and received the USFN member of the year award in 2012. She has participated on numerous high-level committees, including the U.S. Department of the Treasury and the Mortgage Bankers Association of America. SPEAKERS ROY DIAZ, Managing Shareholder | Diaz Anselmo & Associates, P.A. Roy Diaz has been a member of the Florida Bar since 1988, concentrating his practice in the areas of real estate, litigation, and bankruptcy. He has represented lenders, servicers of both conventional and GSE loans, private investors, and real estate developers throughout his career, with an emphasis on the mortgage servicing industry for over 30 years. Diaz is admitted to Federal Court practice in the United States District Court for the Southern District of Florida, Middle District of Florida, and Northern District of Florida. He is also admitted in the United States Court of Appeals for the Eleventh Circuit and is AV Rated by Martindale-Hubbell. He has been a speaker regarding mortgage-related law and procedure with the Florida Bar, ALFN, Five Star Institute, National Business Institute, USFN, and The Legal League 100. ELIZABETH M. DESILVA, General Counsel | McCalla Raymer Leibert Pierce, LLC Elizabeth M. DeSilva is currently the General Counsel for McCalla Raymer Leibert Pierce, LLC. Prior to joining the firm, Elizabeth worked for some of the largest residential and mortgage banking companies in the country. She spent the prior five years as VP and Chief Servicing Counsel of Ditech Financial, where she was responsible for legal oversight of the Attorney Oversight Department, which managed the default attorney referral network. She handled several national/multi-state State Attorney General investigations and related consent judgments, as her work involved representing her clients before the Consumer Financial Protection Bureau (CFPB), Department of Justice (DOJ), Executive Office for United States Trustees (EOUST), and U.S. Department of Housing & Urban Development (HUD). DeSilva is a graduate of Texas Tech University School of Law, where she received a Juris Doctor, in addition to a BA in Government & Business from Texas Woman's University. She was recently named Fellow of the American College of Mortgage Attorneys. McCalla Raymer Leibert Pierce has offices nationwide in Alabama, California, Connecticut, Florida, Georgia, Illinois, Kentucky, Mississippi, Nevada, New Jersey, New York, Ohio, Oregon, Texas, and Washington. DELOISE BROWNE-MILNER, Senior Operations Manager | Freddie Mac Deloise Browne-Milner is the Senior Operations Manager for Foreclosure and Bankruptcy in the Single-Family Operations Division at Freddie Mac. She is responsible for oversight and timely resolution of seriously delinquent loans. Milner has been with Freddie Mac for 18 years and has industry experience in default management, including foreclosure, bankruptcy, loss mitigation, underwriting, exception loan processing, litigation settlements, property preservation, law firm oversight, and mortgage loan originations. TONIQUA GREEN, VP Corporate Social Responsibility | Mr. Cooper Toniqua Green serves as VP of Corporate Social Responsibility for Mr. Cooper Group, overseeing Diversity, Equity, and Inclusion Community Outreach and Environmental Social and Governance (ESG) matters. As the leader of Corporate Social Responsibility, she has oversight of community partnerships, outreach efforts, and government-sponsored initiatives. Green has been with Mr. Cooper for 16 years. She began her career in the call center and has worked in collections, loss mitigation, foreclosure, and compliance before pivoting to Corporate Social Responsibility, where she uncovered her passion. In her current role, she is able to assist borrowers experiencing financial hardship "to keep the dream of homeownership alive" by partnering with Government and Community Partners on Mortgage Assistance Programs.
